These Terms of Service ("Terms") govern your access to and use of SysDraft.dev ("SysDraft," "the Platform," "we," "us," or "our"), including our website, applications, APIs, and related services. By accessing or using SysDraft, you agree to be bound by these Terms.
By creating an account or using any part of the SysDraft platform, you confirm that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using SysDraft on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

SysDraft offers Free, Pro, and Enterprise plans. Features and limitations for each plan are described on our Pricing page and may be updated from time to time.
Pro plan subscriptions are billed monthly or annually in advance. Payment is processed through Stripe. You authorize us to charge your payment method for the applicable subscription fees.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods, except as required by applicable law.
New Pro plan subscribers receive a 14-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
You retain all rights to the content you provide to SysDraft, including prompts, project data, and any custom configurations. The architecture diagrams, IaC scripts, and other outputs generated by our AI based on your inputs belong to you.
SysDraft and its underlying technology, including AI models, algorithms, user interface, documentation, and branding, are the intellectual property of SysDraft Inc. and are protected by copyright, trademark, and other applicable laws.
We grant you a limited, non-exclusive, non-transferable license to use the SysDraft platform in accordance with these Terms and your subscription plan.

Your use of SysDraft is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using SysDraft, you consent to the data practices described therein.
SysDraft offers integrations with third-party services such as GitHub, GitLab, Bitbucket, and cloud providers. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services.
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance, and we will make reasonable efforts to provide advance notice. We are not liable for any downtime, data loss, or service interruptions beyond our reasonable control.
To the maximum extent permitted by law, SysDraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform. Our total liability for any claim related to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
The SysDraft platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that AI-generated outputs will be error-free, complete, or suitable for any particular purpose. You are responsible for reviewing and validating all outputs before use in production environments.
You agree to indemnify and hold harmless SysDraft, its officers, directors, employees, and agents from any claims, losses, or damages (including reasonable attorney's fees) arising from your violation of these Terms or your use of the platform.
We may update these Terms from time to time. Material changes will be communicated via email or through a notice on the platform at least 30 days before they take effect. Your continued use of SysDraft after such changes constitutes acceptance of the updated Terms.
We may suspend or terminate your access to SysDraft if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to our platform, our users, or third parties. Upon termination, you may request an export of your data within 30 days.
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.
